Yes. The practice includes property transaction documents and leases, as well as advice and representation when a dispute has arisen.
At a minimum: the chain of title documents, the seller's right to sell, any mortgage or charge on the property, pending court cases, whether the land is freehold or leasehold, and whether the building has the required approvals. These checks are best done before an advance is paid.
It applies to premises let at a monthly rent of ₹3,500 or less. Tenancies above that are governed by the lease and the Transfer of Property Act, 1882, and disputes go to the civil courts.
No. In Suraj Lamp and Industries v. State of Haryana (2011), the Supreme Court held that a sale through a general power of attorney, an agreement to sell and a will does not transfer ownership. Ownership passes only through a registered sale deed.
